Emotion recognition and the EU AI Act
Definition
Since 2 February 2025, the EU Artificial Intelligence Act has banned AI systems that infer people’s emotions in the workplace and in educational institutions, except for medical or safety reasons. Training tools must therefore stick to observable signals.
Also called
AI Act, emotion detection, emotion inference
What the text says
Article 5 of the AI Act lists among prohibited practices placing on the market and using AI systems to infer the emotions of a person in the workplace or in education, except for medical or safety reasons.
What it means for training
A simulation tool can record what is seen and heard (fast speech, averted gaze, closed posture) but must not conclude that the learner is stressed, angry or sad.
With Face Up
Face Up analyses observable signals (posture, gaze, voice, gestures, pace of the exchange) and does not detect or infer learners’ emotions. This page presents the regulation for information only and is not legal advice.
